Record expungement is possible with a few exceptions. If you have been convicted of a felony or misdemeanor and complied with all conditions of your probation, then you qualify to petition the court to have your case dismissed.
Typically, no. Your attorney will usually be able to appear on your behalf through all stages of the proceedings. In the rare instance that you do have to attend a hearing, we will accompany you every step of the way.
It depends on the county in which you live, but the process usually takes a few months. In cases where clients are actively seeking employment, we can try to expedite the process.
Filing fees vary depending on the county you live in and whether you were convicted of a misdemeanor or felony. If you are unable to pay, all counties have some type of financial assistance available.
Yes. This is one of the benefits of obtaining an expungement. However, there are some exceptions. You cannot answer “no” if you:
- Plan to become a peace officer or run for public office
- Want to work for the California Lottery Commission
- Want to apply for a state license
You will receive a signed order by a California Superior Court Judge. This will declare that your conviction has been set aside and that your case has been dismissed.
